Farmhouse at Fulkerson Winery

An 1856 farmhouse re-finished to accommodate up to 10 people. 4 queen beds. Full kitchen, Living and Dining. Enjoy the beauty of Seneca Lake from the porch with your favorite Finger Lakes wine! Direct access to the Seneca Lake Wine Trail, lake access within 8 miles. Best view on the lake! 6 wineries within 2 miles.

The space

An 1856 farmhouse with the charm that goes along with it. A four bedroom, 2.5 bath home with dining area and full kitchen. Large living areas with room for family fun, corporate retreats, or just enjoying a casual night in with a group! The dining room has table that will extend to accommodate up to 12, dish service for up to 18, kitchen table can extend as well. Gas stove with electric start, and all the appliances and cookware to make a full holiday feast!

I live just down the lane on the other side of the farmhouse. If you need me, or have any questions, please call or text so that I may answer any concerns. Other contact information is in the guest booklet on the kitchen table. The staff at Fulkerson Winery can also help you with any concerns.

Other things to note

We strive to make your stay the best possible. Please call or text with any questions or concerns during your stay. We cannot fix what we don't know about, and if there is anything awry, we would like to make it better!

The outbuildings have a "working farm charm", and may be a little messy due to storage of articles from past generations. Guests have access to the main house. Please keep in mind that this is a working farmhouse and there are older storage buildings on site with farm storage in them. Guest access to outbuildings is not permitted.
The house does sit on NY 14 and can have some road noise.

Terms & Conditions

Thank you for choosing The Farmhouse at Fulkerson Winery as part of your Finger Lakes getaway. The house has four bedrooms, two full baths plus one half-bath and sleeps a maximum of ten people. This agreement sets forth important information. Please read it carefully.

Availability:
The house is available nightly and weekly throughout the year. Monthly rates are available, please inquire. During Peak Season, weekly rentals begin on Friday. Check-in is 3pm. Check-out is 11am.

Damage/Reservation Deposit:
A deposit of $500.00 is required. This payment must be made in cash or by check. It will be taken at the time you arrive. The deposit is NOT applied toward rent; however, it is fully refundable within one week of departure, provided the following provisions are met:
a) No damage is done to the house or its contents, beyond normal wear and tear. Damage includes misplacement or theft of items. An inventory of all house items is well known and kept on file. A copy of this list can be found in your welcome binder. Replacement values have been assessed and recorded by the owner.
b) No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
c) All debris is placed in garbage cans provided.
d) All dishes, glasses, mugs, pots, pans, and utensils are clean and returned to cabinets.
e) All appliances are left clean and in the same condition they were found.
f) Refrigerator and freezer are clean and empty of contents.
g) All keys are left on the kitchen counter and house is left locked.
h) All charges accrued during the stay are paid prior to departure.
i) No linens are lost or damaged. Beds should be stripped and linens accounted for and placed on mattress. Comforters should also be left on the mattress.
j) The premises are left in broom-clean condition.

Booking:
The booking party leader must be at least 21 years of age.

When you receive your confirmation by email, the details must be carefully checked. If anything is incorrect you should inform us within 24 hours by email or telephone.

Please note that there is no “cooling off” period in New York State for this type of business transaction. Once the owner or its agents issue a written confirmation to you, this signifies that the owner or their agents have entered into a contract with you, which is subject to the terms and conditions contained herein and creates a legally binding contractual agreement between you and Fulkerson Winery or their agents.

Cleaning:
We clean and inspect the house prior to your arrival and after you leave. Guests are responsible for any intentional or excessive damage. We also offer mid-week cleaning services for an additional fee. Please contact us if you are interested in mid-week cleaning services. We ask that you leave the house in the condition that it is found by our guests. This ensures that there will be no cleaning fee.

Pet Policy:
We are happy to be a dog friendly location. Dogs are limited to two maximum at the property. There is a non-refundable pet fee that will appear on your rental agreement ($100.00 per dog). Guests will also be asked to review, approve and return a copy of our Pet Agreement. Please let us know when making your reservation if your dog is coming along. Violators of our pet policy may be asked to leave the property without refund or incur a service charge of $300.00 plus any additional cleaning fees and reimbursement for damages.

Occupancy Limits:
The maximum number of allowable occupants is 10 and will be carefully enforced. Children under the age of two are not included in this occupancy count. Please do not bring any campers, tents or motor homes. If you exceed the stated occupancy limit at any time during your stay, we will have to ask you to leave. In a similar fashion, large parties or gatherings are not permitted.

Smoking:
Smoking is absolutely prohibited inside the house or on porches/patios. Please dispose of tobacco products in approved containers.

What to Bring:
The house is equipped with bedding, towels, pillows, blankets/comforters, basic paper products, a coffee maker, mixing bowls, pots, and pans. The house is also equipped with cutlery, place settings, cups, and glasses for 12. Please bring extra paper products (if needed), detergent, and other items not listed here. If you’re unsure of what to bring or have questions as to what the house is appointed with, please give us a call.
Check-In/Out:
Check-in time is 3pm, unless prior arrangements have been made. Please call to inquire if you’d like to arrange an earlier or later check-in/out option is available. You may check-in and pick up the keys to the house at Fulkerson Winery, ¼ mile south at 5576 State Route 14, Dundee, NY 14837. Please check in by 5pm. If you cannot be here by that time, please contact us to make alternate arrangements. Check-out time is 11am.

Housekeeping and Maintenance Services:
If you experience any maintenance or housekeeping concerns, please let us know immediately. Please contact Steven Fulkerson at 607-227-4037. If you have a concern and we do not hear about it, it is difficult for us to make amends, so please call if you have any questions or concerns so we can take care of them immediately. If Steven cannot be reached and you are calling within regular business hours (Monday through Sunday 9am-5pm), please call Fulkerson Winery a 607-243-7883.

Courtesy to House:
We are happy to open the house to our guests. It has been in the Fulkerson Family for over 150 years. We ask that you please treat it as your own, and use it respectfully to minimize the potential for damages. We ask that you comply with all laws and keep the premises as clean and safe as possible. Dispose of all garbage and use the trash receptacles as provided. Keep the plumbing free of toys and other foreign items. Please report any and all damages and problems to us immediately.

Family Atmosphere:
We maintain a family atmosphere for the enjoyment of our guests and neighbors. Absolutely no house parties allowed. No sororities, fraternities or non-chaperoned groups are allowed. Should a group misrepresent themselves, they will be required to vacate the premises immediately without refund.

Vehicles:
No campers, tents or motor homes are allowed on the premises. Vehicle parking is limited to 6 cars and is restricted based on the maximum occupancy of the house.

Off-Season Reservations:
The Finger Lakes can have significant snowfall from November through March, and on rare occasions, beyond these months. Please be prepared with front wheel drive or 4 wheel drive, snow tires, and/or chains. The driveway will be plowed and sidewalks shoveled if the snow fall accumulates to more than an inch.

Agricultural Lands
The property you are renting during your stay with us lies in an agricultural area and farming activities occur in that area. Such farming activities may include, but may not be limited to activities that cause noise, dust, and odor.

Liability and Indemnity:
You acknowledge that the use of the property without continuous on-site owner supervision presents inherent risks. You agree to provide supervision for all members of your group, including, without limitation, minors in your group and minors who might be guests or invitees, and to take due care to assure that the premises and the personal property used in connection therewith are occupied and used in a safe and careful manner.

The owner and its agents shall have no liability for any death or personal injury except to the extent caused by the owner’s or its agents’ gross negligence. You must take all necessary steps to safeguard your property. No liability is accepted by the owner or its agents in respect to damage, loss or theft of such personal property except to the extent caused by the owner’s or its agent’s gross negligence. You hereby release and indemnify and hold the owner and its agents harmless from any claim or expense in connection with injury or death or any member of your party or any guest or invitee of yours, except to the extent caused by the owner’s or its agent’s gross negligence.

The parking of any vehicle on the property is strictly at the vehicle owner’s risk. No liability or responsibility for any theft or damage to any vehicle while parked on the owner’s private property will be accepted by the owner or its insurers.

Insurance and Indemnification:
The Lessee is responsible for insuring any and all of the Lessee's personal property located on the Premises. The Lessee will indemnify and hold the Lessor harmless from any damages or claims, including attorney’s fees, which might arise from any injuries or loss sustained or arising out of the Lessee's, or his invitees' use or occupancy of the Premises. The Lessee agrees to pay for any and all damage caused to the Premises by the Lessee and their invitees.

Complaints:
Every effort has been made to ensure that you have an enjoyable and memorable vacation. This agreement has been made to protect your peaceful occupancy of the property during your vacation stay. If, however, you have cause for complaint, we are anxious to take remedial action as soon as possible. It is essential that you contact us immediately if any problem arises so that it can be speedily resolved.

Right or Tenure:
Nothing in this agreement gives right or effect to the Leasee any protection from eviction laws. Occupancy, the purpose of which is to give the tenant (the renter) the right to occupy the property for a vacation IS NOT an “assured tenancy”. In other words, nothing in the terms or conditions, nor the rental agreement constitutes a landlord/tenant relationship within the meaning of the law.

Law:
The contract between you and the owner or its representative is subject to the Laws of New York State. It is agreed that any dispute will be submitted to arbitration with the Center for Dispute Settlement in Yates County, New York, and parties to this contract waive their right to file a court action over any disputes prior to such arbitration. It is further agreed that all reasonable legal fees and expenses will be paid in their entirety to the prevailing party to any dispute and such reasonable legal fees and expenses to be determined by the arbitrator as a condition of this contract. Any award of the arbitrator shall constitute a final, non-appealable judgment and may be entered as such by the clerk of any court having jurisdiction.

At Termination of Lease:
The Lessee agrees that at the end of the term, he/she will surrender the Premises in as good condition as they received the Premises upon the signing (Agreeing to Terms and Conditions) of this Lease Agreement, except for ordinary wear and tear and damage by the elements. On vacating the premises, Lessee agrees to completely remove all trash, rubbish and garbage from the premises and to leave said premises in broom-clean condition. Upon termination of the lease or upon the tenant vacating the premises and returning the keys to the Lessor (Fulkerson Winery), the Lessor shall inspect the premises for damages and return the deposit, minus any charges for damages made by the Lessee or others during his/her tenancy. In the event the damages exceed the amount of the deposit, the Owner shall withhold the entire deposit, bill the Lessee for the excess amount and may seek any other remedy available under the law. In the event the Lessee utilized a credit card to pay the lease, the Lessee expressly grants permission to the Owner to charge said account for any and all damages. In the event it shall become necessary for Lessor to place Lessee's account in the hands of an attorney for collection of unpaid rent, damages or for eviction of Lessee for violation of this Rental/Lease Agreement or on any other grounds for eviction, the expense of any action, plus a reasonable attorney fee, shall be payable by Lessee, in addition to unpaid rent and/or damages.

Assignability:
This Lease Agreement is not assignable by the Lessee without the express written consent of the Lessor, which consent shall not be unreasonably withheld.

Payment Policy

Half of the gross rental amount plus taxes are due when the reservation is booked, with the balance due upon arrival.

Payment Methods
Payments may be made by cash, in-state check, certified check, traveler’s check, money order, Discover, Visa, or MasterCard. (There is a 3% convenience fee if using credit card for rental.)

Taxes
Properties in Yates County are subject to a Lodging Tax (4% of the rental rate).

Cancellation Policy

Reservation Change & Cancellations
If you need to change or cancel your reservation, you will receive a full refund, less 25% of the gross rental paid to date, if we can re-rent the same property for the same period. If we cannot re-rent the same property for the same period, the full amount pre-paid must be forfeited.

Except where otherwise expressly stated in these conditions, the owner and its agents shall not be liable, jointly or individually, for any changes, cancellations, effects on your vacation, loss or damage suffered by you or for any failure by the owner or its agents to perform or properly perform any of their respective obligations to you which is due to any events or circumstances beyond the reasonable control of either the owner or its agents referred to as “Force Majeure” or “an act of God” in these conditions. By way of example only this includes, fire, flood, exceptional weather conditions, epidemics, pandemics destruction, or damage of the property by any cause other than negligence by the owner or its agents. No compensation, expenses or costs of any description will be payable in such circumstances by the owner or its agents to you in the event of “Force Majeure” or “an act of God”.

We highly recommend that you consider taking out suitable vacation/trip/cancellation insurance. Please contact your insurance broker.
