Gozobreak Ltd. is a small family-run company, based in the Maltese Islands specialising Incoming Travel and managing our own self-catering farmhouses on the west coast of the island of Gozo. Our experience gained over the years in the hospitality and tourism trade enables us to provide the quality service and genuine hospitality. Our aim is to provide our guests with the best value for money, and a holiday they will never forget!

Terms & Conditions

TERMS AND CONDITIONS:

1) Subject matter of the lease agreement: By submitting an offer to execute a lease agreement for a holiday property with Gozobreak Ltd, the lessee declares that he/she fully accepts the General Terms and Conditions listed hereinafter by the lessor as an integral part of the lease agreement.

2) Reservation and lease confirmation: The holiday property may only be leased in writing. With the offer, the lessor bindingly offers the lessee the execution of a lease agreement for a holiday property in Gozo. If the offer is accepted, the lessee undertakes to submit without delay, latest 5 days from receipt of lessor's offer, a written reservation-confirmation (by e-mail and/or fax -as requested). On the other hand, the lessor is bound to confirm by writing (e-mail and/or fax) that he is reserving the property chosen by the lessee, which reservation will be definitely confirmed when deposit is paid by lessee to the leasing company, i.e.. Gozobreak Ltd. or a person on its' behalf (namely Mr. Marvik Borg).

3) Booking Procedure: Lessee shall complete the booking form and provide Gozobreak Ltd. with the requested information to secure the booking. The person who compile the booking must be over 18 years of age and is responsible for ensuring full payment with Gozobreak Ltd.. Lessee will be also responsible for keeping other members of his/her party informed of the booking details. It is advisable that lessee keeps a copy of the reservation form and produces it on arrival.

4) Payment Terms: At the time of reservation, a deposit in the amounting to of 25% (or as otherwise agreed by lessee and lessor) of the total sum, is due for payment. The lessee can choose whether to pay the requested deposit as part of payment or otherwise as a guarantee against any breakages. In the case deposit is paid as part of payment, lessee is requested to produce a valid credit card, together with a photocopy of passport and an amount equivalent to the deposit paid will be blocked against any eventual breakages. In the event where deposit is paid as breakage deposit, this will be refunded to lessee up to 7 days after check out from property. Should there be any damages to the property, and/or other assets within the property such expenses will be deducted from the amount of breakage deposit paid and lessee will be held liable for any extra expenses exceeding the amount paid as breakage deposit. The full amount or balance due must be received either within 30 days prior to the lease agreement or as otherwise agreed by lessee and lessor. Payment has to be done either through PayPal; by Bank Transfer, by Credit Card;) or preferably in cash and in Euro currency on arrival.. A 3.5% charge is applicable for balance payments via Credit Card; a €25 charge on the first €1000 and a subsequent charge of €25 for every subsequent €1000 is applicable when balance due is paid through PayPal.

5) Cancellation Policy: The lessee, wishing to withdraw from the lease agreement MUST inform the lessor without delay. Lessee has the right to refund of the lease rate already paid, minus the compensation listed hereunder, which is computed from the total invoice amount charged for the leased holiday property and lessor's expenses incurred by the withdrawal: If the withdrawal occurs 90 days prior to lease commencement, 25% of the total invoice amount is charged: If the withdrawal occurs between day 60 and day 30 prior to lease commencement, 50% of the total invoice amount is charged; If withdrawal occurs within 30 days prior to lease commencement, 75% of the total invoice amount is charged. Lessor reserves the right to prove and assert higher damage compensation. In all other cases of non-arrival (non-show) or early departure, lessor is due to be paid full amount and NO refund of the lease rate already paid is made.
Likewise, no refund of the lease rate is made if the holiday property is not used owing to false or unclear information of the personal data on the booking/reservation form.
The lessee withdrawing from a lease agreement may offer a substitute lessee, provided that notification arrives in time - i.e. At least 15 days prior to travel commencement. Additional charges may apply accordingly.
Delays in or cancellation of flights, closure of airports and/or ports, adverse weather conditions, technical problems with transport, governmental action or other similar events that that relate to force majeure do not entitle the lessee to a total or part refund of the total invoice amount.
In cases where lessee cannot honour lease agreement, as a result of other causes beyond his/her control; an amicable solution will be reached wherein the lessee will be provided with the option of choosing other dates, depending on availability and keeping in mind that the lease rate may be subject to change.

6) Changes by Lessee: Should the lessee wish to change his/her booking after it has been confirmed (example: Guest names, date changes, etc), he/she must notify Gozobreak Ltd. in writing. The lessor will try to assist but cannot guarantee to meet such requests. These changes may imply the application of cancellation charges as set out in the Cancellation Policy as shown above. Please note that certain special rates are non-changeable and non-refundable once the booking has been confirmed.

7) Withdrawal by lessor: Lessor may only cancel the lease agreement for extraordinary reasons. Such reasons may encompass the fact that the property has become uninhabitable through force majeure.. In this case, the lessee has a right to full refund of the amount paid. If the property becomes uninhabitable only after lessee has moved into the property, the lessor is obliged to provide the lessee with a property of like or better value at the same price. A full or part refund is not made in this case. We do not accept responsibility for any expenses or costs lessee may incur as a result of any change.

8) Lessee is to make sure that the property is available before proceeding with a direct booking. Thus lessee is to e-mail Gozobreak Ltd on info@gozobreak.com before effecting a payment to confirm a booking in order to receive the go-ahead from Gozobreak Ltd. Gozobreak Ltd. reserves the right to cancel a reservation/booking and shall not to be held responsible for an overbooking should the lessee fails to inform Gozobreak Ltd about availability and his/her intentions to proceed with a booking in the 24hours preceding his payment and receive a confirmation by Gozobreak Ltd. that he/she can proceed with the payment to confirm a reservation.

9) MINIMUM STAY: Kindly note that minimum stay for any booking is as per agreement and as accepted by Gozobreak Ltd. Gozobreak Ltd. reserves the right to terminate an agreement and not to refund any amounts paid when Lessee informs Gozobreak Ltd of deductions in the number of days as per previously already agreed upon, which stay might not be considered to be acceptable by Gozobreak ltd.

10) Our Liability to you: The published descriptions of our properties are given in good faith. Gozobreak Ltd. does not accept responsibility for errors or omissions. Sudden withdrawal of certain facilities for a temporary period is beyond our control and we are unable to accept liability.

11) Insurance covers: The lessee is recommended to take out insurance cover for cancellation of travels, health insurance for traveling abroad as well as other insurance covers.

12) Medical Problems: If the lessee has any medical problems or disability which may affect his/her stay the lessee must advice Gozobreak Ltd. before booking is confirmed, giving full details. Such booking may be declined or cancelled in the lessee's best interests if Gozobreak Ltd. feels unable to properly accommodate lessee's particular needs.

13) Other Conditions: Lessee means the person (s) consenting by writing to take a lease agreement for a holiday property belonging to Gozobreak Ltd. or any other person or entity to which the charges incurred under this agreement are to be billed.

The term lessor in the agreement refers to Gozobreak Ltd.

Gozobreak Ltd. leases property to lessee and lessee takes on lease the property described, subject to all terms and conditions of the Agreement.

Lessee is to leave the property in the same condition as when leased, and is ONLY permitted to make use of the property as on the dates specified on the reservation form.

Lessee is to inform Gozobreak Ltd. immediately (during all hours of the day, everyday of the week, including Public Holidays) of any damage or fault occurring within the property, or of any changes to the Agreement.

Gozobreak Ltd. shall not be held liable to any loss/damage of personal belongings while in any of its properties.

Gozobreak Ltd. try to maintain its properties to the highest standards but shall not be held liable for any consequences arising from misuse of equipment and/or property.

To maintain our standards for all guests Gozobreak Ltd. requires that certain conditions be complied with. We, wholeheartedly appreciate that most of our clients will respect our properties, however we must state the following conditions for any occasional abuse that may take place: a) To ensure the property is left in similar state to it's condition on arrival, it is anticipated that the property will be in an acceptable state of repair, with all dishes washed and put away and bench tops cleaned. Gozobreak Ltd. reserves the right to debit any amounts outstanding required for extra charges for cleaning, extra guests staying, extra bedding being used, purchases or charges incurred as a result of damage, theft or loss. b) The properties are situated in a quiet residential area and in the interest of our neighbors, your booking is accepted on the express condition that there is no disturbance after 22.00hrs. Parties and functions are strictly prohibited. The tariff charged is for domestic use only and for the use of our paying guests. Accordingly this rate does not allow for the extra ware associated with functions in terms of cleaning, garbage removal, wear and tear repairs etc. Any usage contrary to this may result in additional payments. c) Please be advised that smoking is not permitted indoors. Smoking is only permitted outdoors.

It is the responsibility of the person making the booking to ensure that the property booked will be suitable for their party size. Please make sure to notify during the booking process any additional supplements (i.e. single occupancy of twin room, or third adult sharing twin room).

Any extension on the leasing of the property MUST be notified to Gozobreak Ltd. immediately and personally. Failure to do so will mean that lessee is liable to pay Gozobreak Ltd. any daily compensation deemed as fit by the lessor.

PETS are STRICTLY not allowed. The lessor reserves the right, if this condition is breached, of non-acceptance of the lessee at the property. At the same time the lessor reserves the right to keep all the deposit/security/breakage deposit already paid by the lessee together with the total invoiced amount due by the lessee.

Photos and Video footage of the premises taken without permission and uploaded on the internet or any other online communication are STRICTLY not permitted. The execution of these acts will be considered unlawful as they go beyond the owner's right of reserve.

Third parties NOT listed on the reservation form are NOT allowed in any of the properties without prior consent by Gozobreak Ltd. Management.

Number of guests should not exceed the number stated on the reservation form, as subsequently agreed in writing or e-mail. Gozobreak Ltd. reserves the right to charge an additional fee per night for use of extra bedding during the stay without prior arrangement.

It is customary that check-out refers to 10.00hrs, while check-in refers to 15.00hrs. However if you are due to arrive/depart before/after the stated time, it is advisable to contact Gozobreak Ltd. directly on confirmation of booking to advise of this.

14) Choice of Law /place of jurisdiction: The lease agreement relating to these General Terms and Conditions is subject to the Laws of Malta. Any default actions or complaints against the lessor/lessee are to be addressed to by arbitration in Malta/Gozo.

Any additions to or alterations of the terms and conditions of this agreement shall be null and void.
